The Massachusetts State Police Challenged on Racial Profiling
My appearance on the O’Reilly factor in 2003, came on the heels of a Superior Court Judge in Worcester allowing the first Motion to Suppress in Massachusetts based on the State Police racially profiling.
Although the Massachusetts Supreme Judicial Court reversed the decision, it ultimately paved the way for future cases based on my theory. It ruled that statistical evidence may be used to meet a defendant’s initial burden of producing sufficient evidence to raise a reasonable inference of impermissible discrimination and that the exclusionary rule can be used where a stop is based on racial profiling.

OUI/Drunk Driving Defense

Various charges can result in minimum mandatory jail sentences meaning unless you have an experience attorney who can fight the constitutional basis of your arrest or negotiate with prosecutors, you may be facing incarceration.
Domestic Violence
Domestic assault and battery charges are extremely common in the state of Massachusetts and can have serious implications. Domestic assault and battery convictions often carry with them requirements that the defendant complete special programs for “batterers”, or anger management programs. Also, those convicted may be ordered to stay away from the person on whom they committed the assault and battery. If a weapon was involved in the altercation, the punishment becomes far more serious. In August 2014, Massachusetts Governor Patrick known as “Act Relative to Domestic Violence,” which changes the arraignment, bail, detention, and criminal penalties in domestic violence cases.

Speeding Tickets/CDL Violations
A driver speeding 15 miles per hour over the speed limit will receive a $155 fine. And for most drivers, the ticket itself is only the first cost associated with speeding—they often face insurance increases as well. On average, Boston area drivers pay $259.96 more per year in premiums after receiving a speeding ticket. In Massachusetts, speeding tickets stay on drivers’ records for six years and insurers penalize drivers as long as there the infraction is on their records, which means that Boston-area drivers end up paying $1,559.75 total in increased premiums. Tack on the cost of the ticket, and that comes to a whopping $1,714.75. Worcester is just a shade below.
Firearm Offenses
Every citizen of the state of Massachusetts has the right granted to them by the 2nd Amendment of The Constitution to keep and bear arms. If you have a clean mental health and criminal history there is no reason for any citizen in Massachusetts to be denied these given rights. Massachusetts has strict gun and weapons possession laws. If you are convicted of carrying a firearm without an F.I.D card, you face a mandatory minimum eighteen-month house-of-correction sentence. A Mandatory minimum sentence means that the judge has no discretion to impose a lighter sentence or to provide probation.
A SHORT STORY

My interest in criminal law began while attending University of Miami School of Law. During my second year , I was able to secure an internship with the State Attorney’s Office as a student prosecutor. I worked under Janet Reno, who later became our United States Attorney General.

Michael Erlich is a beast in that courtroom. He does NOT play when its game time! Michael Erlich immediately returned all phone calls as soon as possible whenever I had any questions or concerns about my case. My car was illegally searched by a state trooper where a firearm was found in a locked glove compartment during an inventory search which holds a minimum mandatory sentence of 18 months in the house of corrections. We tried for a motion to suppress the evidence but for some reason we were denied. The commonwealth refused to give us a plea bargain which left us no choice but to take it to trial. Michael Erlich was very honest & realistic with our chances of winning from the beginning. During our jury trial Michael Erlich worked hard to expose all lies in the troopers testimony during cross examination. Michael Erlich was able to prove my innocence & we walked out with a “not guilty” verdict to “possession of a firearm” “possession of ammunition” & “improper storage of a firearm”. Not Guilty!
Atty. Erlich represented me for a Domestic A & B out of Fitchburg district court. He was very communicative throughout the whole process and he always returned calls and texts promptly. He clearly knows the law and how to present the case to a jury so that they can see the truth and come to the right conclusion. While I hope to never need him again I wouldn’t hesitate to hire him again if I did and would recommend him to anyone who needed representation of this kind.

Not guilty! Thank you Mike! God Bless you!
Being falsely accused of a domestic assault charge was my situation I was dealing with. My reputation was at stake. My job was also on the line because if convicted on this false claim I would of been fired on the spot. Basically the ripple effect of damage of a guilty verdict would of been severe on me and my future. If you’re reading this and are going through the same thing, I feel your pain of what you’re dealing with! Getting the right lawyer to fight in your corner is a biiiig deallll! Stressful to even rethink about when I was searching for my lawyer before I hired Mike. (A good name is more desirable than great riches; to be esteemed is better than silver or gold. -Proverbs 22:1) How true this is! To me this was so important and i cant stress that enough. Trusting another person to help defend your case is a really hard spot to be in. Mike really listened to me and payed close attention to details in everything that I could possibly tell him regarding my case. Getting in touch with a lawyer can be difficult at times in my experience ,however that wasn’t the case with him. Every time I reached out to Mike he responded and made me feel that he was taking my case seriously as it was serious to me. At trial is where I really saw how good he is at what he does. He argued my case so well it was even better then my high expectations were for him! I was so thankful for my not guilty verdict! Justice was served! At the end of the trial even one of the people who worked for the court house and sat next to the judge asked for his business card lol. Just goes to show how well he did in the court room and other peoples opinion of him in the field.
